Summer is in full bloom and all things thrive. Recently, the 2nd Case Sharing Session cum Birthday Party hosted by Shanghai BillionsLawyer LLP was warmly held in the Salon Meeting Room. Colleagues from Shanghai Penglian Law Firm were specially invited to exchange ideas and learn together. A substantial and vigorously discussed sharing event unfolded in a harmonious atmosphere. Staff from the Finance Department first delivered a systematic briefing on internal invoice submission requirements, OA invoice uploading procedures and specifications for three-expense declaration, helping all colleagues clarify key points of financial compliance and offering practical guidance to boost daily work efficiency.

Subsequently, Attorney Xu Ruiyu presented an in-depth analysis of a non-prosecution case concerning the crime of dangerous driving. Taking a case as the starting point: the client slightly scratched another vehicle while moving the car a short distance after drinking alcohol (prerequisites: the client bore full liability and exceeded the alcohol limit) but had already ordered a designated driver. She fully reviewed the complete defense strategy from case intake to the issuance of the non-prosecution decision. Two factors were critical to the favorable outcome. First, accurate argumentation on subjective intent. Screenshots of the designated driver order and dashcam footage proved the client moved the vehicle to hand it over to the designated driver, rather than driving on roads subjectively, which conforms to the applicable scenarios in judicial interpretations: “moving vehicle for parking” and “handing vehicle to another person to drive”. Second, compelling argument on the nature of the location. Attorney Xu argued that the scene (nighttime parking lot/alley) did not constitute a “road” in the sense of Criminal Law, negating the constitutive elements of the crime of dangerous driving.

The case delivers valuable enlightenment: even where full liability exists, practitioners should overcome reluctance, thoroughly explore applicable conditions for non-prosecution under judicial interpretations, combine similar case retrieval with multiple approaches, and ultimately secure a non-prosecution result. This case provides a clear defense roadmap and precious practical reference for the team handling similar drunk driving cases.

Right afterwards, Attorney Quan Hanlin delivered a presentation on AI application skills in legal practice. He systematically introduced user-friendly domestic AI tools (such as Tencent Yuanbao and Doubao), and demonstrated core application methods under real scenarios: using AI to inspect documents to rapidly spot typos, confused subject identities, logical contradictions and calculation errors; adopting the mode of “providing background + establishing framework + generating/revising clause by clause” in contract drafting to avoid quality defects caused by generating complete contracts directly; leveraging AI to sort out legal relationship diagrams, disputed focal points and response strategies for urgent consultations to support quick client responses; and emphasizing no arbitrary addition or deletion when translating long texts to guarantee information integrity.

Attorney Quan noted: AI serves as a powerful auxiliary tool for legal work. However, practitioners must stay alert to the risk that AI may fabricate legal provisions and precedents. All generated content requires manual verification, and final deliverables must be reviewed by attorneys. Tools improve efficiency, yet professional judgment always rests with humans.

The presentations by the two attorneys featured detailed breakdown of practical operations as well as sharp insights into cutting-edge technology, sparking heated discussion and profound reflection among attendees.

Warm Birthday Celebration to Strengthen Fellowship

Following the professional sharing, the event entered the warm birthday party segment. Two birthday honorees, Director Li Yamin and Attorney Gao Zichun from Penglian Law Firm, took the stage in turn to share birthday wishes with sincere and touching remarks.
